According to transit police, 41-year-old Juan Tavarez took a seat on a nearly empty train directly next to the victim around 11 a.m. Aug. 5, sat down and allegedly exposed his genitals to the victim and “committed a lewd act.” Police said he used a newspaper to shield his genitals from view of others on the train so that only the victim could see.

The victim exited the train at the next available stop—Malden Center—and Tavarez is said to have fled and boarded a train going in the opposite direction. Officers caught up with Tavarez at Wellington Station and after being positively identified by the victim, he was arrested for open and gross lewdness.

Tavarez is also the suspect in two prior open and gross lewdness cases from 2018 on the orange line, according to transit police.
